Service Members Civil Relief Act (SCRA) 

Service Members Civil Relief ActService Members Civil Relief Act is only valid during the time of Active Duty orders.

 

Upon returning home, KEEP IN MIND...
  • You will now have to notify creditors of Active Duty ending.
  • The whole family will have to prepare for change in payments and interest rates.
  • Legal proceedings deferred for military separation must be addressed.

Service Members Civil Relief Act (SCRA)   
  • All creditors who received the notification of military orders will be returning payments to previous amounts as well as interest rates reinstated.
  • Legal proceedings which are deferred during military separation will now have to be addressed.  For example, legal proceedings that may include mortgage foreclosure, civil judicial proceedings, and income tax payment.  
  • Just as A review of the Family finances should be completed prior to the Military separation, the same should be done upon the soldier's return home.

If you think that you have rights under the SCRA that may have been violated, or that you are entitled to be shielded from a legal proceeding or financial obligation by the SCRA protections, you should discuss the matter with a legal assistance attorney or a civilian lawyer as soon as possible.
